TRANSACTIONS ABOUT THE GUARDIANS WHOSE GUARDIANSHIP EXPIRES DURING COVID-19 PROCESS

Within the scope of the methods of combating with Covid-19 pandemic which shows its effect these days; hearings are postponed and the legal periods are paused besides some exceptions in order to prevent the risks arising during the execution of judicial activities. However, in this context, it is emphasized that urgent transactions or transactions related to detained people should be evaluated sensitively.

In the meeting held by the Council Of Judges And Prosecutors, it has been stated that there were grievances because of not showing the necessary sensitivity about the extension of the duties of guardians whose guardianship has expired in accordance with Article 456 of Turkish Civil Code by some Civil Courts of Peace.

In this respect, The Council of Judges and Prosecutors has sent a letter to the Heads of the Justice Commissions on 13.04.2020 about acceptance of proceedings related to guardians whose guardianship has expired as “urgent matters” and has warned the judges of the Civil Courts of Peace to show the necessary sensitivity to carry out guardianship renewals without any delay in order to prevent disadvantaged persons who are decided to be restricted or taken under guardianship for any other legal reason, not to victimize them during the execution of the measures taken within the scope of the combat against the pandemic.
